From an Insider, it seems the OCPD may have more problems on its hands. Is this Insider providing some great new information? Judge for yourself.
I am writing in regards to the DUI stop of Rep. John Atkins by the Ocean City Police Department. These are facts that the department won’t release and that the public has not heard. The Ocean City Police Department has lied to the news media.
The OCPD started out by saying that Pfc. Doug Smith is a DUI expert. The OCPD later said that there was not enough evidence to arrest Atkins. However, he blew a .14 in the preliminary breath test. So how is it that the OCPD’s DUI expert cannot find enough evidence to arrest someone that is almost twice the legal limit? The reason is because the officer never had Atkins conduct any roadside field sobriety tasks. The officer pulled over Atkins, learned who he was, and then learned that he was drunk. The officer then talked to his supervisor about the incident, and the supervisor advised Smith that it would be best not to arrest Atkins and just find him a ride home. And who drove Atkins home?
It was a Delaware State Trooper. The trooper came into Ocean City and drove Atkins to his home in Milford, Delaware. Atkins then got into a domestic fight with his wife and was arrested.
The reason why Smith did not make the arrest was because he was afraid of the political consequences that it would cause him. In the early days of the incident the Chief DiPino also stated that the officers can use discretion. Pfc. Smith has never used discretion in DUI cases because he has arrested firefighters, correctional officers, his own dispatcher, and two police officers for DUI, one of whom was an Ocean City Police Officer. Pfc. Smith is all about the stats and would probably arrest his own mother for DUI. Do not be fooled by the department’s lies. This is just a small reflection of Smith and DiPino’s corruption.

I haven’t gotten to many political events this month. That may need to change with the announcement that the Western Sussex Republicans will be having a Ronald Reagan Birthday Bash on February 6. Likely to be found decorating the party are “Just Say NO” placards and the pink-slips of the air-traffic controllers Reagan fired.
But that’s not the best part. You know crazy-ass Republicans know how to have a good time! And in Sussex it’s a fuckin’ free-for-all. This celebration is going to be held…get THIS…at GOLDEN CORRAL!
Nothing says conservatism like a trip to an all-you-can-eat buffet where the cheap sons-of-bitches can munch on shit to leave them stuffed for a week! Kind of like the national budget under George Bush. Buy now, pay later. Eat now…pay later via repeated trips to a Sussex outhouse!
Future wannabe governor and State Sen. Charlie Copeland will be the guest speaker. No word on whether he’ll select the “Awesome Pot Roast” or signature “Meatloaf” for his main course. I didn’t know DuPont-boys were so fond of going DOWN the food chain!

Which state lawmaker was seen at a party hosted by Gov. Minner on Tuesday? Further, this lawmaker was seen by several individuals who claim he/she was drinking heavily and wasn’t even invited to the party!
The state lawmaker the next day had to head into the hospital for some emergency surgery.
Of course, DWA wishes this state lawmaker all the best and hopes he/she will be back on the party circuit soon!

Millsboro Republican Rep. John C. Atkins had his gallbladder removed today.
They don’t write them any better or more to the point than that! Of course, there are even more details behind the gallbladder story that would send anyone to the hospital from keeling over laughing, but maybe later…

My spam filter is doing an over-efficient job of trapping comments. Most all of the comments are being placed in the filter and I fear I may have deleted some. I have my thoughts as to how this is happening and I feel someone may be attacking DWA with spam.
Anyway, if you could, please forward me a copy of ALL comments you send in. Do this by clicking the “Contact DWA” button in the top left. Put your name and email and the comment and click send and I’ll make sure to post it in case I accidentally delete it.
Case in point: I arrived home last night to more than 600 pieces of spam in the filter. I didn’t go through them all. I just clicked “Delete.” I’m sure I got rid of some good comments. I apologize. So just please CC me.

DWA has exclusively obtained the schedule of President George W. Bush’s trip today. And, when I say exclusively, I mean on top of the other news outlets who received it 12 hours ago.
Here:
Bush is touching down at New Castle County airport about 9:55 am. He’ll be heading to the DuPont Experimental Station for a tour shortly thereafter and will arrive at the DuPont Theatre at 10:55 for a brief speech. According to my source, there will be mucho-press coverage of this, the President’s first visit after yesterday evening’s sweltering State of the Unioin Address.
Something tells me you may be able to access some exclusive Bush-ian goodness via this blog link on WDEL’s site later today.
So head on into the city today and say hello to my favorite lowest-polling-president George Bush for me.

In John Atkins’ case, nothing seems to go his way. Rep. John Atkins has so much mud that he’s trying to scrape off himself and throw at everyone else only to find it perpetually flinging back in his face.
Someone has been anonymously shopping stories to various news outlets slinging mud on perceived enemies of John Atkins or those he holds responsible for his situation.
What’s funny is I can find the person responsible for this situation at any time. And that person needs only to find a mirror.

I emailed Rep. Bob Valihura last night to ask him why he initiated and sponsored HB 9, which would essentially cover certain criminal acts committed by public officials as “class G felonies.” Rep. Valihura’s political venture must have lots of money in its coffers, because the response I received from him seemed to be typed and rehashed by some PR pro who ignored the original question posed by the press mob. With that being said, I must admit I didn’t even read the whole thing, but you all can feel free. Mofo didn’t even preface the email with a salutation. Homeboy just got right down to spin-filled business. His response:
The campaign for Attorney General raised some excellent issues, and one of those was whether our abuse of office statutes were up to date. As the only attorney elected member of House Majority Caucus, and as Chair of the Judiciary Committee, I took a great interest in this issue during the campaign. My research indicated that many states had upgraded their public corruption statutes to make the crimes already on the books felonies rather than misdemeanors. I concluded that ours needed updating as well.My colleagues in the House Majority Caucus thought enough of the idea to include it as one of our Nine in Nine agenda items, and as I mentioned last week during the press conference regarding this agenda proposal, while there is no pressing need for this legislation nor have I seen evidence that indicates that public officials are engaging in the illegal conduct prohibited by the current statutes, it is better to have tougher penalties in place now, should the need ever arise. Indeed, although the General Assembly is often criticized for being reactive, this is simply proactive good government legislation. Further, as I also learned, someone who is convicted for a crime under one of the current abuse of office statutes could continue to hold public office, or just as troubling, could run for elective office. A felony conviction, as provided for in this legislation, would now bar such officer from holding elective office. As a policy matter, I believe strongly that someone convicted of these types of crimes should not be holding a office of public trust.

Alexander Snyder-Mackler, the young one who serves as communications director for the Delaware Democrats, is a little upset I’ve spent too much time bashing Rep. John Atkins. He’s upset I haven’t lit a fire under the ass of Sen. Charlie Copeland for obstaining from voting at the confirmation of Former Atty. Gen. Carl Danberg to the position of corrections commissioner.
My good friend Mr. Snyder-Mackler alerted me to this fascinating piece of news two days ago and, because of my awfully busy life, I’ve failed to follow-up to his delight. Anyhow, looks like my friend has pulled through today and done it on his own! I guess he just wanted one of the big guns to handle this story seeing as how Blue State Rising has been BEGGING for readers and commenters since its inception several months ago.
So, Sen. Copeland…screw you! Asking 5,000 questions and then not casting a vote? Who the fuck do you think you are? A 2008 gubernatorial candidate?

John Atkins is, as the say, toast. Not even his compadres within his own Republican caucus seem to be coming to his defense. Case in point: Though it isn’t specific, a new bill was introduced today in the House in which four House Republicans are seeking to Amend Title 11 of the Delaware code relating to “official misconduct” by public officials.
This bill rewrites the two above offenses to make them class G feleonies for public officials to abuse their official positions to benefit themselves.
So why exactly was this bill sponsored by Rep. Bob Valihura, with Reps. Terry Spence, Wayne Smith, and Biff Lee (all three the Republican leaders in the House) all co-sponsoring? Is this a ceremonial piece of hooey meant to show some leadership on the part of House Republican to show they’re not interesting in playing Rep. Atkins’ games any more? Or was there some other force behind the bill?
Either way, this is quite an interesting development and is bringing us closer to the theory that it is House Republicans who are looking to clean House of this nuisance known as John Atkins. Though there are so many angles of this already-sordid tale, I’m hesitant to discuss them much here because the details could get me into some trouble of the libel/slander kind because, frankly, most of the other knowledge I have can’t be confirmed until that elusive Millsboro Police Department report is released.
Rep. Smith…will we be seeing that document’s release any time soon?? Had enough fun yet?
Update I: This just in from Rep. Wayne Smith. After asking him about why this bill was introduced today, Rep. Smith had this to say:
HB9 is part of our January Agenda. There really was not a good official misconduct law; Ferris Wharton raised this issue during the campaign and several legislators took a look at the issue and agreed.
